These Terms govern your use of the public Fixr website (the "Site"), operated by Fixr Asset Intelligence Inc., based in Victoria, British Columbia, Canada. By using the Site you agree to them. If you do not agree, please do not use the Site.

What these Terms cover, and what they do not

These Terms apply to the public Fixr marketing website and the informational content on it.

Once you sign in to use the Fixr application, including any account, free trial, or paid subscription, your use of the application is governed by a separate services agreement, not by these Terms.

The distinction matters. These Terms cover marketing pages and informational content only — not the product, your account, or the data you put into it. If the two documents ever conflict, the services agreement controls the application and these Terms control the public Site.

Who may use the Site

You must have the legal capacity to enter a binding contract, and must not be barred from doing so under applicable law. If you use the Site on behalf of a company or other organization, you confirm that you have authority to bind that organization. The Site is intended for businesses and is not directed to children.

Changes to these Terms

We may update these Terms at any time. When we do, we revise the date at the top of this page, and for material changes we will make reasonable efforts to bring them to your attention. Your continued use of the Site after an update means you accept the revised Terms.

Changes to the Site

We may change, suspend, or remove any part of the Site at any time, without notice. Some plans, features, and integrations described on the Site are illustrative or on our roadmap and may not be available yet.

Marketing statements are not commitments

Statements on the Site about future products, features, availability, pricing, roadmaps, early access, or trials reflect our current intentions. They are not binding promises and may change. The terms that actually apply to you are the ones presented to you at sign-up and set out in the separate services agreement.

Joining an early-access or waitlist form is a request to be contacted. It does not create an entitlement to access, to a particular feature, or to a particular price.

Demonstrations on the Site, including the demo film and the interactive app preview, use illustrative buildings, people, and records. They are not recordings of live customer data and not measured results.

Your permission to use the Site

We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to access and view the Site for informational purposes and to evaluate Fixr for your business. This licence does not transfer any ownership to you, and we may revoke it at any time.

Things you agree not to do

You agree not to:

  • Copy, reproduce, republish, or distribute content from the Site, except as these Terms allow.
  • Scrape, crawl, harvest, or use automated means to extract data from the Site, except for well-behaved search-engine crawlers.
  • Reverse engineer, decompile, or attempt to derive the source of any part of the Site.
  • Interfere with the Site's operation, probe it for vulnerabilities, or attempt to gain unauthorized access to any system.
  • Introduce malware, or use the Site to send spam.
  • Misrepresent your identity or your affiliation with any person or organization.
  • Frame or mirror the Site, or remove any proprietary notice from it.
  • Use the Site in violation of applicable law or these Terms.

Ownership and intellectual property

The Site and everything on it — text, images, illustrations, graphics, logos, layout, design, and code — is owned by us or our licensors, and is protected by Canadian and international intellectual property laws. The Fixr name and logo are our marks. The limited licence above is the only right granted to you; no other right to the Site or to our marks transfers to you.

Feedback

If you send us a suggestion, idea, or other feedback about Fixr, you grant us a perpetual, irrevocable, worldwide, royalty-free licence to use it for any purpose without any obligation or compensation to you.

Third-party sites and services

The Site may name or link to third-party products and services. We do not control and are not responsible for those third parties, and naming or linking to them is not an endorsement. Your use of them is governed by their own terms and privacy practices.

Where the Site displays data from public government sources, it is provided as-is by those sources and we do not warrant its accuracy or currency. Parcel data is used under the Open Government Licence – British Columbia and recall data under the Open Government Licence – Canada, with attribution shown where it is displayed.

The demo film's music is "Executive Presence" by Turning Pages, used under the Pixabay Content License.

Privacy

Our Privacy Policy explains how we handle personal information. By using the Site, you consent to the handling of information as described there.

Disclaimers

The Site and its content are provided on an "as is" and "as available" basis. Content on the Site is general information only and is not professional, legal, engineering, or safety advice.

To the maximum extent permitted by law, we disclaim all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Site will be accurate, complete, secure, uninterrupted, or error-free.

Limitation of liability

To the maximum extent permitted by law, neither we nor our affiliates, officers, employees, or agents are liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, or goodwill, arising from or relating to your use of, or inability to use, the Site.

Our total aggregate liability for all claims relating to the Site will not exceed one hundred Canadian dollars (CAD $100).

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages, so parts of these sections may not apply to you.

Indemnity

You agree to indemnify and hold harmless us and our affiliates, and their respective officers, employees, and agents, from any claims, damages, liabilities, and reasonable expenses, including legal fees, arising from your misuse of the Site, your violation of these Terms, or your violation of any law or third-party right.

Governing law and jurisdiction

These Terms, and any dispute arising from them or from the Site, are governed by the laws of the Province of British Columbia and the applicable federal laws of Canada, without regard to conflict-of-law principles. You agree that the courts located in Victoria, British Columbia have exclusive jurisdiction, except that we may seek injunctive relief in any court of competent jurisdiction to protect our intellectual property.

General

These Terms, together with any policies they reference, are the entire agreement between you and us regarding the Site, and supersede any prior understanding about it. If a provision is found unenforceable, the rest remains in force. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them, including in a merger or sale of the business. Nothing here creates a partnership, agency, or employment relationship. Headings are for convenience only.
